Subscription Agreement for Thai Move Property Services
This Subscription Agreement (the “Agreement”) is entered into between Thai Move Property Services (the “Company”) and the subscriber (the “Subscriber”) for the use of the web portal www.thai-move.com (the “Portal”). This Agreement is effective as of [Effective Date].
1. Subscription Terms
1.1 Subscription Period: The subscription is valid for a period of 12 months from the date of payment.
1.2 Payment Levels
1.2.1 Bronze Subscription: In consideration for an annual payment of 1,000 THB, the Subscriber is granted the right to list one property on the Portal.
1.2.2 Silver Subscription: In consideration for an annual payment of 10,000 THB, the Subscriber is granted the right to list up to 100 properties on the Portal. Additionally, the Company guarantees a minimum of 3 enquiries over the subscription period.
1.2.3 Gold Subscription: In consideration for an annual payment of 50,000 THB, the Subscriber is granted the right to list up to 1,000 properties on the Portal. Additionally, the Company guarantees a minimum of 5 enquiries over the subscription period.
1.2.4 Platinum Subscription: In consideration for an annual payment of 100,000 THB, the Subscriber is granted the right to list an unlimited number of properties on the Portal. Additionally, the Company guarantees a minimum of 10 enquiries over the subscription period. In the event that this guarantee is not met, the Subscriber is entitled to a 100% refund of the subscription fee after the conclusion of the subscription period.
1.3 Payment: The payment is a one-time, non-refundable fee for the selected subscription level.
2. Money-Back Guarantee
2.1 Guarantee Terms: The Company provides a 100% money-back guarantee if, at the conclusion of the 12-month subscription period, the Company underachieves in generating enquiries for the properties listed on the Portal.
2.2 Guaranteed Enquiries
2.2.1 Silver Package Guarantee: For subscribers with the Silver Package, the Company guarantees a minimum of 3 enquiries over the subscription period.
2.2.2 Gold Package Guarantee: For subscribers with the Gold Package, the Company guarantees a minimum of 5 enquiries over the subscription period.
2.2.3 Platinum Package Guarantee: For subscribers with the Platinum Package, the Company guarantees a minimum of 10 enquiries over the subscription period. In the event that this guarantee is not met, the Subscriber is entitled to a 100% refund of the subscription fee after the conclusion of the subscription period.
2.3 Payment of Guarantee: The money-back guarantee shall be payable only at the termination of the 12-month period.
3. Exclusivity and Discounts
3.1 Restrictions: The money-back guarantee cannot be combined with any other offer, discount, or promotional arrangement.
4. Service Description
4.1 Objective: The Company’s service aims to generate enquiries for the properties listed by subscribing agents on the Portal.
4.2 Listing Limits: The number of property listings allowed is determined by the selected payment level:
4.2.1 Bronze: 1 property listing 4.2.2 Silver: Up to 100 property listings 4.2.3 Gold: Up to 1,000 property listings 4.2.4 Platinum: Unlimited property listings
4.3 No Sales Guarantee: The Company does not guarantee property sales as part of its service.
5. Subscriber Responsibilities
5.1 Accurate Information: Subscribers are responsible for providing accurate and up-to-date information about the listed properties.
5.2 Compliance: Subscribers agree to comply with all applicable laws and regulations related to property listings.
6. Termination
6.1 Termination Rights: Either party may terminate this Agreement with written notice if the other party breaches any material term or condition.
7. Miscellaneous
7.1 Entire Agreement: This Agreement constitutes the entire understanding between the parties and supersedes any prior agreements or understandings.
7.2 Amendments: Any amendments to this Agreement must be in writing and signed by both parties.
7.3 Governing Law: This Agreement shall be governed by and construed in accordance with the laws of Thailand.
